It is important that your estate plan, insurance policies, and any gifts from any person that could bring your child with special needs assets to an amount greater than $2,000, be given to the special needs trust, and directly to the child with special needs.
Under a special needs trust, your child will still be eligible for Supplemental Security Income (SSI). SSI is a government program that assists people with low incomes who have special needs. In order to qualify for SSI, an applicant or beneficiary can have only $2,000 in his own name. If the person has more than $2,000 in his own name, the government allows him to qualify for SSI so long as the assets are in a special needs trust.Â
